Rental Terms

All car rentals through Swinton are governed by a comprehensive Rental Agreement that you will receive upon booking confirmation or at the time of vehicle collection. This document outlines important terms, conditions, insurance specifics, applicable charges, and your responsibilities for that rental. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.

Eligibility Criteria

Requirements for Vehicle Rental

• To rent a vehicle from Swinton, you must be at least 21 years old, though age restrictions can vary based on vehicle type. Drivers younger than 25 may incur additional fees. A valid full driving license is required, along with proof of identity and current address. Valid payment details and a security deposit are also necessary, along with any other conditions outlined in the Rental Agreement.

3. Reservations and Payments

• Reservations for car hire can be made on our website, by telephone, or directly at our Dartford office. A booking deposit may be necessary to confirm your reservation. The remainder of the payment, along with a security deposit, is generally due upon vehicle pickup. All prices are quoted in British Pounds (£) and include VAT where relevant. We accept major credit and debit cards, processed securely with trusted payment providers.

Vehicle Pickup and Drop-off

• At the time of collection, you are required to examine the vehicle thoroughly and report any pre-existing damage without delay. A vehicle condition report will be completed and signed by both parties. Please return the vehicle in the same condition as it was collected, accounting for normal wear and tear. Any new damage will be evaluated and charged accordingly. The vehicle should be returned with the same fuel level as received; otherwise, refueling charges will apply. If you expect to return the vehicle late, please contact us as soon as possible, as additional charges may be incurred. You will be responsible for any parking tickets, traffic fines, or other charges that arise during the rental period, along with an administration fee.

Insurance and Liability Coverage

• Third-party insurance is included with every car rental at Swinton. You can find specific coverage details and excess amounts in your Rental Agreement. Additional insurance options may be offered to lower your financial liability. It's wise to evaluate these alternatives thoroughly. You will remain liable for damages or losses up to the excess amount unless supplementary insurance is purchased. Any damage resulting from negligence, misuse, or violation of these Terms will be your responsibility, regardless of existing insurance.

Cancellation and Modifications

Cancellation and amendment policies differ based on the type of booking and the notice given. For precise information, please consult your booking confirmation or Rental Agreement. Be aware that late cancellations or no-shows could incur additional charges.

Prohibited Activities

Prohibited vehicle uses:

• Vehicles rented from Swinton must not be used for any illegal activities or purposes. This includes racing, off-roading, or any other dangerous driving. Using the vehicle to transport hazardous materials or allowing unauthorized drivers is prohibited. Driving under the influence of alcohol or drugs is strictly forbidden. Additionally, the vehicle should not be used for purposes it was not designed for, and exceeding passenger or weight limits is not permitted. Driving outside of the agreed geographical boundaries without prior authorization is also prohibited.

Breach of these terms may lead to rental cancellation and fees.

Liability Limitations

To the fullest extent allowed under English and Welsh law, Swinton Car Hire will not be responsible for any indirect, incidental, or consequential damages, including loss of profits, data, or business, that may result from your use of our services. Our total liability for any claims will not exceed the total payment made for your rental in the past 12 months. This limitation does not apply to liability for death or personal injury resulting from negligence or fraudulent actions.

9. Applicable Law

These Terms are governed by the laws of England and Wales. Any disputes will fall under the exclusive jurisdiction of the courts in that region.

10. Updates to Terms

Swinton reserves the right to update these Terms at any time. Changes take effect immediately upon publication on our website. Continued use of our services indicates your acceptance of the revised Terms.
